I know OUAT is wishy washy with its rules of magic at the best of times and sometimes we just have to accept the show for what it is but I'm legit having trouble with this one since it really doesn't make any sense to me. However, Hook did not use magic for evil nor kill a tethered one himself.

Instead he had the dark magic that was used to tether Merlin to Excalibur pushed upon him unwillingly, so wouldn't that just make Emma darker? I don't understand how it makes Hook dark, let alone a Dark One. The rules of this magic are clear, drink from the holy grail or kill one who has (if tethered, I.e the DO) to gain their power.

This transfer is too convenient. It would have made so much more sense if Hook killed Merlin 😪 • • • • •. Like Gwake98 said, there is still some flashbacks to Camelot to be had, it is possible that Hook goes dark there.

There is also the potential that the act itself turned him dark. We saw it turn Emma dark, and despite having noble goals it was a dark act (seems most dark ones have noble goals but selfish motives). She forced the darkness onto him to save him when he was ready to die for her own selfish reasons.
